In the early 20th century, India was a British colony under the Raj. Along with other colonies in Asia and Africa, India gained independence from Britain in 1947. The Indian Independence Act in 1947 created a new dominion called Dominion of India which didnt exist before the Act came into effect on 14 August 1947. This act also reaffirmed certain rights and privileges of Indians residing outside of Indian territory such as their right to hold property and vote, while others such as their right to enter, remain in and leave India were not covered by this law. Indians who were away from their homes and job during the partition of India were not allowed to go back and take what they had owned in order to live there again. However, after the transfer of power in 1947, Indians living in or outside India were allowed equal rights. The Constitution of India (1949) was created and this constitution grants freedom of religion, freedom of right to property and freedom of employment for all its citizens. The Indian National Congress (INC), led by Jawaharlal Nehru, was evolved as an umbrella organization encompassing all left-inclined opposition groups. Nehru’s view of Indian freedom was based on a non-communal vision. Gandhi’s views, on the other hand, were narrow and communally motivated. Thus Indians had to choose between Gandhi and Nehru as leaders as they decided their future as an independent country.
